					<description><![CDATA[The only question asked at the LPAT hearing, (under the previous LPAT rules) was if councils decision at the time conformed with Provincial policy.  

What is clear, the previous councils decision of 17 storeys has prevailed at LPAT causing Reserve to withdraw their appeal.  What is not clear, would a council decision for a lower building have produced the same results. 

Will Reserve come back with a new proposal ?  If they do they are not limited to the in force 17 storeys and again the current Burlington OP and ROP would be the determinative documents.  How the current Mayor and Council would deal with that would be interesting to watch.]]></description>
